Description of Breach(es)

Being a person who is the main contractor at a workplace where demolition work other than class 1, class 2 or class 3 demolition work is being done, failed to ensure that work was done in accordance with AS 2601, contrary to Regulation 3.123(1) of the Occupational Safety and Health Regulations 1996 made under the Occupational Safety and Health Act 1984

Background Details

On 18 November 2010 the Accused, trading as Jag Demo & Cartage was the main contractor at 86 Cleveland Street, Dianella (the Site).

The Accused was engaged by the owner of the Site, to demolish a single storey residential building on the Site.

On 18 November 2010 the Accused was undertaking demolition work other than class 1, class 2 or class 3 demolition work at the Site.

Prior to commencing the Demolition Work, the Accused failed to ensure that electricity services on the Site had been properly disconnected and sealed away.

Overhead consumer power lines remained connected to the single storey residential building on the Site whilst the Demolition Work was been carried out by the Accused, contrary to AS 2601.

The Site was accessible via a section of fencing around the perimeter of the Site which had fallen down.

The Site was across the road from The Australian Islamic College (Perth).
