Background Details |
The Accused at the date of the offence was an owner of 93 Uduc Road, Harvey. Demolition of that premise requires a class 2 demolition licence. At all material times the Accused had not applied to the WorkSafe Western Australia Commissioner for a class 1 or class 2 demolition licence, and the Commissioner had not issued the Accused with a class 1 or class 2 demolition licence. The Accused obtained a quotation from a demolition contractor for the demolition of 93 and 95 Uduc Road, Harvey, in August 2006. The quotation provided to Mr Mooeny from J & P Group stated a class 2 licence was required. On about 11 June 2008 the Accused obtained a building licence from the Shire of Harvey for the demolition of the building at 93 Uduc Road, Harvey. That licence was conditional upon notifying any body that regulates the work. The Accused and his friends then carried out the demolition work themsevles without obtaining a class 1 or class 2 licnece. |
